Commission Agreement for Creation of Art Work

The Commissioner, ___________________________________________________,    at the address _______________________________________________________, phone number_________________, acknowledges sufficient familiarity with the style and quality of the work of the Artist, Ruth S. Soller, residing at 3307 Columbine Ct, Broomfield, CO 80020, Phone: 303-469-2072, email SollerOriginals@juno.com.  The parties have made and entered into this agreement on this _____________day of ________________,200___. 

1. DESCRIPTION:  The Artist, in consideration of the covenants and agreements herein contained, agrees to create an art Work described as:

(hereinafter “Work”) for a total recompense from the Commissioner of $_____________for the design and creation of the work, and the materials contained and used by the Artist in creation of this work.

2. AGREEMENT:  The receipt of good and valuable consideration in the amount of $_______, or 33 percent of the total recompense for the Work, received on this day by the Artist is hereby mutually acknowledged.  In return for this deposit, the Artist agrees to prepare the Work described above and present it to the Commissioner.  The Artist will retain this deposit in the event the Commissioner does not accept the Work.  The remainder of the total recompense will be remitted to the Artist upon delivery of the Work to the Commissioner, and acceptance by the Commissioner that the Work does in adequate respect fulfill the agreed upon description in this contract.

3. ASSIGNMENT:  Any and all rights, including trademarks and copyrights in the Work being created, for purposes of reproduction of the Work, are assigned to the Artist.  Should Commissioner wish to reproduce the Work by any means, for commercial or non-commercial purposes, written permission must be granted by the Artist, subject to an agreement between Commissioner and Artist concerning properly crediting and compensating the Artist.  This does not detract from the Commissioner’s ownership of the original Work upon acceptance and payment of the total recompense to the Artist.
